OXO Loyalty Program Terms of Use
Welcome to the OXO International, LTD. – DBA OXO® (”OXO," "we,” “our,” “us”) Loyalty Program. These terms and conditions govern the OXO Loyalty Program (the “Program”) and your use of it.
The Program is subject to the specific Terms and Conditions provided below as well as the Terms of Use of the OXO website, available at https://www.OXO.com/terms (“Terms and Conditions of Use”, incorporated here by this reference) (collectively with these OXO Loyalty Program Terms & Conditions, the “Terms”).
BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS. PLEASE NOTE: THESE TERMS CONTAIN A CLASS ACTION WAIVER AND JURY TRIAL WAIVER, AS DETAILED IN THE “LEGAL DISPUTES” SECTION, BELOW.
OXO reserves the right to change or modify any of the terms and conditions contained in the Terms and guidelines and rules (if any) from time to time at any time, without notice, and in its sole discretion. If OXO decides to change these Terms, OXO will post a new version on its website and update the date set forth above. ANY CHANGES OR MODIFICATIONS TO THESE TERMS, GUIDELINES, OR RULES WILL BE EFFECTIVE UPON POSTING OF THE REVISIONS. THE UPDATED TERMS WILL REPLACE THE PRIOR VERSION AND ARE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES, REGARDLESS OF WHEN THE DISPUTED INTERACTIONS AROSE.
Affiliates of OXO (e.g. Hydro Flask and Osprey) may also have similar rewards programs. Participation in the Program does not confer any rights or benefits in the program of any other OXO affiliate.
1. Program Description, Eligibility and Points
The Program is a free rewards program offered by OXO. The Program is a points-based program with different membership tiers. The Program allows participants to earn Points (as defined below) for every dollar spent on Eligible Product Purchases (as defined below) and, from time to time, through other special promotions as determined by OXO in its sole discretion. Membership in the Program is limited to individuals only and is limited to one account per individual. Participation in the Program is limited to persons residing in the United States who are 18 years of age or older. For the avoidance of doubt, only natural persons transacting in their personal capacity and for their own account are eligible to participate. No business entities, third-party aggregators, organizations, or groups may register for the Program or earn Points.
The Program is a customer loyalty program that allows Program Members (as defined below) to receive and redeem loyalty points for every dollar spent on Eligible Product Purchases (“Points”) to earn Rewards (as defined below) and other Member Benefits (as defined below) on an individual basis for their own account. A Member may receive Points and Member Benefits based on their Membership Tier (as set forth below) through Eligible Product Purchases. Points are not earned on sales tax, shipping charges, gift card redemptions and gift card purchases. In addition, Points and Membership Benefits may be earned through other actions or opportunities as may be presented by OXO from time to time. These opportunities may vary and are only valid as set forth in the individual offer but may include possible offers such as bonuses for creating an account (limit once per member), bonuses for referring a friend, providing a product reviews, following OXO on designated social media outlets, and points on your birthday (limit of one time per member per year). Points for such activities will be awarded as described in the applicable offer and will be subject to any additional terms set forth with that offer. The number of points earned for each action will be stated on the website and is subject to change at any time without prior notice.
There is no fee associated with the Program. Participation in the Program is personal and non-transferable. Points, Membership Tiers, Rewards and Member Benefits may not be gifted, purchased, sold, bartered, brokered or otherwise transferred. Points, Rewards, and Member Benefits available via the Program have no cash value, are not redeemable for cash, gift certificates or gift cards, are purely promotional, and do not constitute property of any participant. No portion of any payment for purchases qualifying for the Program or any Points, Membership Tier, Member Benefits, or Rewards constitute consideration paid for any of the foregoing. OXO reserves the right to limit the redemption of specific Rewards and Member Benefits and limit the number of Points, Rewards, and Member Benefits available.
2. Joining the Program
To participate in the Program and be eligible for the benefits of a Membership Tier, eligible individuals must enroll and become a member of the Program (“Member”). OXO reserves the right to limit participation and enrollment at any time. To become a Member you must provide the required information and sign up at https://www.oxo.com/rewanyards. No purchase is necessary to become a Member. Signing up is free. You agree to provide true and accurate information and to ensure that at all times information provided by you is up-to-date and accurate. Communications with you will be made using contact information most recently provided by you. OXO is not responsible for your inability to receive or redeem Points or Member Benefits.

The benefits available to a Member through the Program are based on the Membership Tier and the number of Points that the Member receives through participation in the Program (collectively, the “Member Benefits”). OXO is under no obligation to provide Members with any particular number of Point-earning opportunities. The different membership tiers are set forth in the above table (the “Membership Tier,” and collectively, “Membership Tiers”).
4. Points
Points are automatically tracked at the time of the qualifying purchase, transaction, or activity on www.OXO.com (the “Eligible Product Purchases”). Points for any single qualifying purchase or activity may only be credited to one (1) Member account. OXO reserves the right to designate certain products on OXO.com as Eligible Product Purchases or may exclude certain products from eligibility from time to time in its sole discretion. Points will be credited to the account upon consummation of the qualifying transaction or activity garnering Points. In certain cases, it may take 48 hours or more for Points to be credited. OXO shall not be responsible for, or liable to, any Member, person or entity, in any way, for any losses, costs or expenses incurred by a delay or error in crediting Points or Membership Tier benefits to a Member's account. Available Points totals for a Member account will be displayed in the Member’s account or at check out. OXO may provide additional avenues for collecting points in its sole discretion from time to time.
5. Purchase Activity
You will receive Points for qualifying purchases and transactions following enrollment as a Member in the Program based on your Membership Tier. You will not receive Points for any amounts paid in shipping or delivery fees, sales taxes or purchases of gift cards.
6. Membership Tiers and Points
Each Member will be assigned a Membership Tier status which are based upon dollars spent at checkout on Eligible Product Purchases less any dollars spent on sales tax, shipping charges, Gift card redemptions and Gift Card purchases. Each Membership Tier has its own benefits as stated on http://OXO.com. Reward Points may not be combined with any other coupons or discount codes. When Members return products, Points previously posted to Member’s Account for that purchase will be deducted from Member’s Account. Once a Membership Tier is earned, that tier will be kept by the Member for a period of twelve (12) months. At the end of that twelve (12) month period, if the required points for the Membership Tier Points are not once again achieved through new Points earned, the Membership tier for the Member will revert to the lowest tier. Points expire after twelve (12) months of inactivity. Customers who exceed 12 months without completing one of the below-mentioned actions will lose their accrued point balance: creating an account, making a purchase on OXO.com, redeeming points, or receiving a perk/reward. This includes all perks except for earning Points via the Birthday and Anniversary campaign.
7. Redeeming Rewards (100 Points is $5 Off)
Points may be redeemed for dollars off on a future OXO product purchase, which is only valid on OXO.com (a “Reward”). 100 Points can be redeemed for five dollars ($5) off a future purchase as a Reward. You must have at least enough available Points in your account (“Available Points”) for the Reward. Members must accrue a minimum of one hundred (100) Available Points before the first redemption for any Reward. In any single transaction, only one account may be used to redeem Points for Rewards. Points accrued by a Member in any purchase or transaction may only be redeemed for Rewards in a separate, subsequent purchase or transaction.
Points will be subtracted from the Member's account immediately when a Reward is requested based on the total Points for the requested Reward. OXO reserves the right to limit the redemption of specific Rewards and limit the number of Rewards available at any particular Membership Tier at any time in its sole discretion.
8. Special Member Benefits
OXO, in their sole and absolute discretion, may periodically offer the opportunity for additional rewards or benefits on particular transactions or special offers as additional Member Benefits. Any Member Benefits may be distributed online or via email from time to time in OXO’s sole discretion. If a Member has opted out of OXO emails they will not receive Loyalty emails. They must opt back in by re-submitting their email address in the site form.
9. Expiration of Points
Points expire after 12 months of inactivity. Members who fail to redeem any earned or given Points within the twelve (12) month period will lose those Points, reducing their total balance of Points to the remaining points earned within the twelve (12) month expiration period. This applies to all Membership Tier perks except for earning points via the Birthday and Anniversary campaign as set forth in the Membership Tier. Unredeemed Points expire upon the cancellation or termination of your account.
10. Cancellation, Termination
At our sole discretion, we have the right to modify, add or delete all or any portion of these Terms, benefits, Points or Rewards, at any time, with or without notice, even though such changes may affect the value of points already accumulated, the value of the rewards and/or the time for redemption. If the Program is terminated or the Member’s account is closed, any remaining earned Points will be forfeited.
We reserve the right to change, modify or terminate the Program, or any or all benefits under the Program or any policy pertaining to the Program, at any time, for any reason, including our right to discontinue or change the Membership Tiers or change the expiration date or redemption value of Points or Rewards, merge the Program with another program, or to adjust how Points or Rewards are received, calculated or redeemed.
11. Resolving Disputes
If a dispute should arise between you and OXO, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our customer service team, reachable at https://www.oxo.com/contact-us/.
If your dispute cannot be resolved using our customer service team, these Terms describe how we shall proceed with the resolution of the dispute.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND OXO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. The preceding sentence does not apply to New Jersey residents.
12. Legal Disputes; Class Action Waiver; Jury Trial Waiver
YOU ALSO AGREE TO THE FOLLOWING PROVISIONS:
PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND TO HAVE A TRIAL IN FRONT OF A JURY.
NO CLASS ACTIONS: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.
WAIVER OF JURY TRIAL: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS THEY MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTES WHATSOEVER BETWEEN THE PARTIES, INCLUDING BUT NOT LIMITED TO, DISPUTES IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS OR THE RELATIONSHIP OF THE PARTIES (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY).
13. Choice of Law/Forum Selection
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, excluding its conflict of law rules. You further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in El Paso County in El Paso, Texas. This provision does not apply to residents of New Jersey.
14. Severability
The provisions of this Program are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by OXO, or alternatively, by a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Terms without affecting the validity, legality or enforceability of any of the remaining provisions.

16. Restrictions
The following is a non-exhaustive list of activities that are not permitted and that will disqualify Referrers and Referees from earning credits through the Referral Program: (i) self-referral; (ii) making purchases on behalf of another or under an account that is not yours; (iii) creating fake accounts, blogs, web pages, profiles, websites, links or messages; (iv) any bulk email distribution, submission or distribution to strangers, or any other promotion that would constitute or appear to constitute unsolicited commercial email or "spam"; (v) posting your referral link on any page that is not owned and controlled by you, including, but not limited to, any merchant, social media, or forum page; (vi) bidding on any keywords containing OXO marks or common misspellings thereof; (vii) placement of our logos or mention of our trademarks or tradenames in any ad text, extensions or banner ads; (viii) paid advertising for the purpose of generating traffic directly to your referral link; (ix) misleading or attempting to mislead anyone in connection with the Referral Program, including, but not limited to, misrepresenting your relationship with us or posing as our representative in an official capacity; and (x) taking any action or making any content that is disparaging or defamatory to us. Multiple accounts created with the same name, address, email address or other identifying feature may be flagged as fraudulent referrals. Referral Credits are not valid for cash or cash equivalent or previously paid product purchases. No exchange of value for the Referral Program invitation or any Referral Credit (whether cash, product or barter) is allowed, and Referral Credits cannot be transferred to other people or accounts.
Referral Credits cannot be combined with any other discount codes. Referees may only earn one Referral Credit per referred person. In the event a Referee returns a purchased item relating to the Referral Program, the associated Referral Credit awarded to the Referrer will be rescinded. Any abuse of this offer, as determined by OXO in its sole discretion, may result in the rescission of the referring Referrer’s Referral Credit and the inability to participate in this or future promotions. Referral Credits cannot be applied to previous purchases, are not redeemable for cash and are not transferable.
The amount of Referral Credits that you may receive and the time period in which you may earn Referral Credits are subject to limitation.
17. Reservation of Rights
We reserve the right to withhold, deny or cancel any Referral Credits and/or terminate your account if OXO, in its sole discretion, deems any Referral Credit as fraudulent, abusive, unethical, suspicious or otherwise inconsistent with these Referral Program Terms, the General Terms and Conditions or any other applicable law or regulation. Our decisions are final.
18. Termination
We reserve the right to suspend or terminate the Referral Program or to change these Referral Program Terms at any time and for any reason in our sole discretion.
